SPIDERZ SPORTS MEGA DRAFT TOURNAMENT

PARTICIPANT AGREEMENT, WAIVER, AND RELEASE OF LIABILITY

IMPORTANT: READ CAREFULLY BEFORE REGISTERING

This Agreement contains a release of liability and waiver of certain legal rights. By registering for any Spiderz Mega Draft tournament, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions set forth below.

1. TOURNAMENT-SPECIFIC TERMS

The following tournaments are governed by this Agreement, with specific dates and deadlines as indicated:

2026 Spring Training Mega Draft

  • Live Draft Date: November 20, 2025
  • Final Refund Deadline: February 13, 2026
  • Scheduled Tournament Start: February 19, 2026
  • Uniform Pickup Date: February 19, 2026
  • Cancellation Period: November 21, 2025 – February 23, 2026
  • Final Prize Distribution Deadline: March 13, 2026

2026 New Years Mega Draft

  • Live Draft Date: November 6, 2025
  • Final Refund Deadline: December 26, 2025
  • Scheduled Tournament Start: December 31, 2025
  • Uniform Pickup Date: December 31, 2025

2. PAYMENT AND REFUND POLICY

2.1 Registration Fee

All registration fees are non-transferable. Participants may not sell, assign, or transfer their tournament spot to any other person. All sales are final subject only to the refund provisions explicitly stated in this Agreement.

2.2 Administration Fee

All participant-initiated cancellations are subject to a $30.00 administration fee, which will be deducted from any refund issued.

2.3 Payment Methods

Refunds, when applicable, will be issued to the original form of payment used for registration within 15 business days of approval.


3. CANCELLATION BY PARTICIPANT

3.1 Cancellation Before Live Draft Date

If you cancel your registration before the Live Draft Date for your tournament:

  • Spiderz Sports will, in good faith, attempt to fill your spot from the waiting list
  • If a replacement participant is found, you will receive a refund of your registration fee LESS the $30.00 administration fee
  • If no replacement is found, no refund will be issued

3.2 Cancellation After Live Draft Date Through Final Refund Deadline

If you cancel on or after the Live Draft Date but on or before the Final Refund Deadline:

  • You will receive a refund of your registration fee LESS:
    • $90.00 (jersey production fee)
    • The full cost of any optional add-on purchases (official tournament jerseys, companion jerseys, bag tags, or other optional add-on merchandise)
    • The $30.00 administration fee
  • Your custom team jerseys (3) and any optional add-on items will be shipped to you approximately 10-15 business days after tournament completion
  • Shipping costs will be paid by Spiderz Sports

3.3 Cancellation After Final Refund Deadline

If you cancel after the Final Refund Deadline for your tournament:

  • NO REFUND will be issued under any circumstances
  • You will receive your complete uniform package LESS the hat, shipped approximately 10-15 business days after tournament completion
  • Shipping costs will be paid by Spiderz Sports

3.4 Cancellation Requests

All cancellation requests must be submitted in writing to: SpiderzMegaDrafts@gmail.com


4. TOURNAMENT CANCELLATION BY SPIDERZ SPORTS

4.1 Cancellation During Specified Cancellation Period

If Spiderz Sports cancels the tournament during the Cancellation Period specified for your tournament (as listed in Section 1):

  • You will receive your complete custom Uniform Package as full satisfaction of services and products rendered
  • NO REFUND of registration fees or optional purchases will be issued
  • You acknowledge that the custom-made Uniform Package represents significant value and was produced specifically for you

4.2 Uniform Package Delivery

If the tournament is cancelled before the scheduled Uniform Pickup Date:

  • Spiderz Sports will ship your complete Uniform Package via USPS Priority Mail or UPS Ground
  • Shipment will occur no later than the Final Prize Distribution Deadline specified for your tournament
  • All shipping costs will be paid by Spiderz Sports

4.3 Prize Distribution Upon Cancellation

Before First Pitch: If the tournament is cancelled before the first pitch of the first scheduled game, all tournament prizes and awards will be distributed via random drawing giveaways and contests conducted on the Spiderz Mega Draft Facebook Group via Facebook Live, no later than the Final Prize Distribution Deadline specified for your tournament.

After First Pitch, Before End of Play-In Round: If the tournament is cancelled after the first pitch but before completion of the Play-In Game Round, all prizes and awards will be distributed via random drawing giveaways and contests on Facebook Live, no later than the Final Prize Distribution Deadline.

After Completion of Play-In Round: If the tournament is cancelled after completion of the Play-In Game Round(s), all prizes and awards will be distributed at the sole discretion of the Tournament Director based on standings and/or performance at the time of cancellation.

4.4 Force Majeure

Spiderz Sports reserves the right to modify, postpone, or cancel any tournament due to Force Majeure events, including but not limited to: severe weather, natural disasters, acts of God, government orders or restrictions, facility unavailability, public health emergencies, or any other circumstances beyond Spiderz Sports' reasonable control.

4.5 Tournament Format Modifications

The Tournament Director reserves the right to modify tournament format due to time constraints caused by weather or Force Majeure events, including but not limited to:

  • Converting any game to a 1-pitch format
  • Eliminating the Play-In Game Round
  • Eliminating the Dog-House Bracket
  • Eliminating the Loser Bracket
  • Modifying or eliminating the 4-game guarantee
  • Adjusting time limits for games
  • Modifying bracket structure or playoff format

Such modifications do not constitute grounds for refund or cancellation by participants.


5. ASSUMPTION OF RISK

5.1 Acknowledgment of Inherent Risks

Participant acknowledges and understands that participation in softball tournaments involves inherent risks, dangers, and hazards, including but not limited to:

  • Being struck by a softball, bat, or other equipment
  • Collisions with other participants, spectators, or fixed objects
  • Falls, trips, and loss of balance
  • Overexertion and dehydration
  • Extreme weather conditions
  • Field conditions including uneven surfaces, holes, or slippery areas
  • Injuries resulting from the actions or inactions of other participants
  • Equipment failure or malfunction
  • Inadequate first aid or emergency response

5.2 Voluntary Participation

Participant acknowledges that participation in the tournament is completely voluntary and that Participant has freely chosen to participate despite these risks.

5.3 Physical Condition

Participant represents and warrants that they are in good physical condition and have no medical conditions that would prevent safe participation in strenuous athletic activity. Participant is solely responsible for determining their fitness to participate.

5.4 Medical Insurance

Participant acknowledges that they are responsible for obtaining and maintaining adequate medical and health insurance coverage. Spiderz Sports does not provide medical insurance for participants.


6. RELEASE AND WAIVER OF LIABILITY

6.1 General Release

To the fullest extent permitted by law, Participant, on behalf of themselves and their heirs, executors, administrators, personal representatives, and assigns, HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Spiderz Sports, its owners, officers, directors, employees, agents, contractors, volunteers, sponsors, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, causes of action, costs, expenses, and damages of any kind or nature whatsoever, whether known or unknown, arising out of or related to:

  • Any injury, illness, death, or property damage sustained by Participant during or related to the tournament
  • Any negligent act or omission by the Released Parties, except for gross negligence or willful misconduct
  • The condition of tournament facilities, fields, or equipment
  • Transportation to, from, or during the tournament
  • Any Force Majeure event or circumstance
  • Tournament cancellation, modification, or postponement
  • Any conduct or actions of other participants or spectators

6.2 Spectator Release

If Participant is attending as a spectator only, Participant acknowledges the risks of being struck by balls or equipment and releases the Released Parties from liability for any injuries sustained while spectating.

6.3 Emergency Medical Treatment

Participant authorizes Spiderz Sports and its representatives to obtain emergency medical treatment for Participant if necessary. Participant agrees to be solely responsible for all costs associated with such medical treatment.


7. INDEMNIFICATION

Participant agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, and attorneys' fees arising out of or related to:

  • Participant's violation of this Agreement
  • Participant's violation of any law, regulation, or rule
  • Participant's negligent or willful conduct
  • Any injury or damage caused by Participant to any third party
  • Any claims brought by Participant's family members, guests, or invitees

This indemnification obligation shall survive termination of this Agreement and Participant's participation in the tournament.


8. CODE OF CONDUCT

8.1 Zero Tolerance Policy

Spiderz Sports maintains a ZERO TOLERANCE POLICY for the following conduct:

  • Physical fighting or violence of any kind
  • Threats of violence or intimidation
  • Discrimination based on race, color, religion, sex, national origin, age, disability, sexual orientation, gender identity, or any other protected characteristic
  • Harassment or bullying of any kind
  • Profane, abusive, or offensive language directed at participants, umpires, staff, or spectators
  • Unsportsmanlike conduct that disrupts the tournament or violates the spirit of fair play
  • Intoxication or use of illegal substances
  • Damaging or vandalizing property

8.2 Enforcement and Penalties

Spiderz Sports reserves the right to immediately and permanently eject any participant or spectator from the tournament and premises for violating the Code of Conduct, with no refund of registration fees or optional purchases. Ejection decisions are final and not subject to appeal.

8.3 Additional Consequences

Violations of the Code of Conduct may also result in:

  • Suspension or lifetime ban from all future Spiderz Sports events
  • Forfeiture of prizes, awards, and tournament standings
  • Referral to law enforcement if applicable

8.4 Attendance Requirement

Participants agree to be present and ready to play for all games scheduled for their team. Absences or tardiness may result in removal from the tournament without refund.


9. MEDIA RIGHTS AND PUBLICITY RELEASE

9.1 Grant of Rights

Participant hereby grants to Spiderz Sports, its representatives, employees, licensees, and assigns (collectively, "Authorized Parties") the irrevocable, perpetual, worldwide, royalty-free right and permission to:

  • Photograph, record, and/or video Participant during the tournament and related activities
  • Use, reproduce, publish, distribute, display, edit, modify, and create derivative works from such photographs, recordings, and videos (collectively, "Media")
  • Use Participant's name, likeness, image, voice, performance, and biographical information in connection with the Media

9.2 Permitted Uses

Participant acknowledges that the Media may be used for any lawful purpose, including but not limited to:

  • Promotional and marketing materials
  • Advertising campaigns
  • Websites and social media platforms
  • Brochures, flyers, and print publications
  • Educational and instructional materials
  • News coverage and press releases
  • Tournament documentation and archives
  • Commercial purposes including sale of merchandise

9.3 Waiver of Rights

Participant waives any right to:

  • Inspect or approve the finished Media or its use
  • Receive compensation or royalties for use of the Media
  • Assert claims for invasion of privacy, right of publicity, defamation, or copyright infringement related to authorized uses of the Media

9.4 No Expectation of Privacy

Participant acknowledges that the tournament is a public event and that Participant has no reasonable expectation of privacy while participating in or attending the tournament.

9.5 Third-Party Use

Participant acknowledges that third parties, including other participants, spectators, and media outlets, may also photograph or record the tournament, and Spiderz Sports has no control over such third-party uses.

9.6 Opt-Out Not Available

Due to the public nature of the tournament and the team-based format, individual opt-out from photography and video recording is not available. By registering, Participant accepts that their image may appear in Media.


10. GENERAL PROVISIONS

10.1 Age Requirement

Adult Participants (18+): Participant represents and warrants that they are at least 18 years of age and have full legal capacity to enter into this Agreement.

10.2 Entire Agreement

This Agreement constitutes the entire agreement between Participant and Spiderz Sports regarding the subject matter herein and supersedes all prior or contemporaneous communications, agreements, and understandings, whether written or oral.

10.3 Amendments

Spiderz Sports reserves the right to modify this Agreement at any time. Participants will be notified of material changes via email. Continued participation after notification constitutes acceptance of the modified terms.

10.4 Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

10.5 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of WISCONSIN, without regard to its conflict of law provisions.

10.6 Jurisdiction and Venue

Any legal action arising out of or relating to this Agreement or the tournament shall be brought exclusively in the state or federal courts located in WAUKESHA COUNTY, STATE OF WISCONSIN. Participant consents to personal jurisdiction in such courts and waives any objection to venue.

10.7 Waiver

No waiver by Spiderz Sports of any breach or default under this Agreement shall constitute a waiver of any subsequent breach or default. No waiver shall be effective unless in writing and signed by an authorized representative of Spiderz Sports.

10.8 Attorney's Fees

In the event of any dispute arising out of this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and costs.

10.9 Binding Effect

This Agreement is binding upon and inures to the benefit of the parties and their respective heirs, executors, administrators, personal representatives, successors, and assigns.

10.10 Counterparts and Electronic Signatures

This Agreement may be executed in counterparts, each of which shall be deemed an original. Electronic signatures shall have the same legal effect as original signatures.

10.11 Construction

This Agreement shall not be construed more strictly against either party regardless of who drafted it. Headings are for convenience only and do not affect interpretation.

PARTICIPANT ACKNOWLEDGMENT AND AGREEMENT

BY REGISTERING FOR A SPIDERZ MEGA DRAFT TOURNAMENT, PARTICIPANT ACKNOWLEDGES THAT:

·        I have carefully read this entire Agreement and fully understand its contents

·        I understand that this Agreement contains a release of liability and waiver of legal rights

·        I am voluntarily participating in the tournament with full knowledge of the risks involved

·        I understand the refund policy and accept that refunds are limited as stated

·        I agree to abide by the Code of Conduct and understand the consequences of violations

·        I grant Spiderz Sports the rights to use my image and likeness as described

·        I am at least 18 years old

·        I have asked questions about anything I do not understand and am satisfied with the answers

·        I am signing this Agreement freely and voluntarily without any inducement


NOTICE: THIS IS A LEGALLY BINDING CONTRACT. IF YOU DO NOT UNDERSTAND ANY PART OF THIS AGREEMENT, CONSULT WITH AN ATTORNEY BEFORE REGISTERING.
